Here you can find Menovia's terms and conditions for our services and treatments.

Menovia General Terms and Conditions

1. Definitions

In these General Terms and Conditions, the following definitions apply:
- Menovia: Menovia, based in the Netherlands, including its employees, doctors and partners.
- Client: the person who uses Menovia services.
- services: all care, treatments, consultations, examinations (including blood and DNA tests), hormone therapy (including bioidentical hormone therapy), supplement advice and aftercare that Menovia offers.
- Agreement: the agreement between Menovia and the client in which Services are provided under these General Terms and Conditions.
- Intake: the first interview/review of a medical questionnaire, complaints and any investigation to determine whether and how Menovia can provide the Services.
- Trajectory: the complete guidance process, usually six months, as described in the Menovia Basis or Menovia Complete program, including monitoring, adjustment and evaluation.

2. Applicability
These General Terms and Conditions apply to all offers and agreements between Menovia and clients, unless otherwise expressly agreed in writing. By registering with Menovia, the client agrees to these terms and conditions.

3. Registration, intake and agreement

DThe client signs up via the website, completes a medical questionnaire and has an intake interview.
2. Menovia assesses the client's eligibility for the program (Basic or Complete) based on medical information, blood and DNA tests.
3. After approval, a treatment plan will be drawn up. The client confirms agreement by signing the agreement or accepting it digitally.
4. If the client decides not to participate after intake/examination, the costs of components already carried out (such as blood or DNA tests) cannot be recovered.

4. Price, payment and costs
1. The agreed prices are as stated on the website at the time of registration, including intake costs, monthly costs for the process, and total costs over the term (usually six months).
2. Supplements, hormone preparations, medications or forms of treatment that fall outside the standard format are not included unless explicitly stated. These are invoiced separately.
3. Payment must be made using the payment methods accepted by Menovia, within the period specified in the invoice.
4. In case of late payment, Menovia is entitled to charge interest and administrative costs.

5. Treatment process & medical implementation
1. Menovia works with qualified BIG-registered doctors and/or medical specialists for assessment, treatment plans, monitoring and adjustment.
2. Hormone therapy is only started after relevant blood and/or DNA tests have been performed and assessed.
3. Client undertakes to follow Menovia's recommendations, including laboratory appointments, medication instructions, check-ups and lifestyle advice.
4. Menovia draws up its treatment plans carefully, but cannot guarantee individual response, duration of effect or outcomes, given the individual differences.

6. Duration, termination and continuation
1. The process starts on the agreed date (after intake and first payments). The duration is usually six months, with fixed evaluation times.
2. At the end of the process, Menovia and the client will discuss together whether continuation is desirable or whether the client can continue with the aftercare option or guidance via a doctor.
3. If the client terminates prematurely, obligations for services and investigations already performed will remain, and refunds may be limited or not possible.

7. Liability
1. Menovia performs all medical procedures and advice with the utmost care. Nevertheless, there may be (side) effects or unexpected events.
2. Menovia's liability is limited to the amount that the client has paid for the service in question, with a maximum not exceeding what is usual for that service. This does not include external costs such as medication, pharmacy costs or additional specialist examinations.
3. Menovia is not liable for damage caused by the client's negligence in following instructions, or due to the use of improperly stored or misused prescribed drugs.

8. Privacy & Medical Data
1. All health data, DNA tests, blood tests, etc. are treated by Menovia in accordance with Menovia's privacy statement and the GDPR.
2. Medical data is only shared with third parties if the client gives permission, or if required by law.
3. The client has all rights such as access to his own file, correction, deletion, objection, etc. as described in the privacy policy

9. Intellectual Property
1. All content on the Menovia website, including texts, images, logos and treatment plans (unless otherwise agreed) are owned by Menovia and protected by copyright.
2. Client receives a license to use the treatment plan for personal use, but may not disclose or share it commercially without permission.

10. Force majeure

Menovia is not liable for shortcomings in the fulfillment of its obligations if these are due to causes beyond its control. Think of natural disasters, pandemics, failures, supply problems of pharmaceutical products, etc.

11. Applicable law and disputes
These terms and conditions are governed by Dutch law. Disputes arising from or related to the agreement will preferably be resolved by mutual agreement. If that is not possible, the competent court in Menovia's registered office has jurisdiction.

12. Changes to the Terms
Menovia reserves the right to change these Terms and Conditions. The effective date of changes is clearly communicated on the website. Clients who are already participating in a process will be informed about significant changes.

1. Purpose of treatment and telehealth
This treatment agreement concerns participation in Menovia's program, focused on hormonal balance, lifestyle improvement and remote medical guidance (telehealth). Treatment can include consultations, diagnostics, laboratory tests, bioidentical hormone supplementation, supplement advice and lifestyle changes.

Menovia uses telehealth, where electronic means of communication (such as video consultations, telephony or secure messages) are used for medical guidance. This is done via secure platforms in accordance with the AVG and the Medical Treatment Agreement Act (WGBO).

2. Type of service
The treatment consists of:
- Medical intakes and (tele) consultations with BIG-registered doctors
- Diagnostics (including blood tests, questionnaires, AI-driven analysis)
- Treatment with supplements, bioidentical hormones, medication or lifestyle advice
- Follow-up via digital consultations and secure means of communication

3. Information, risks and expectations You declare:

- To be adequately informed about the nature, purpose, expected results and possible risks of the treatment, including the use of off-label medication (articles 1 (3) and (4) of the WGBO).
- Understands that side effects may occur, including hormone-related symptoms (headache, mood swings, bleeding, breast tension, etc.) or reactions to supplements.
- Understands that cosmetic or functional results cannot be guaranteed.
- Understands that we cannot guarantee that all your symptoms can be fully explained by hormonal changes in the menopause. The human body is a complex and integrated system, and complaints can be multifactorial. It is possible that some symptoms may not or only partially improve despite treatment.

4. Telehealth: Benefits, Limitations, and Consent
Benefits:
- Accessible care from home
- Continuity of care in case of reduced mobility or geographical distance

Restrictions:
- Not suitable for all medical complaints (in case of emergency or physical examination)
- Technical issues may affect quality
- There is always a low risk of data leaks when communicating digitally

YOU:
- Agrees to allow Menovia to use telehealth
- Will provide a quiet and private space during digital consultations
- Has the right to withdraw your telehealth consent at any time

5. Participant responsibility and commitment You declare:

- Make every effort to follow the treatment plan
- To follow the doctors' recommendations as closely as possible
- Provide accurate and honest medical information
- Truthfully complete questionnaires
- Failure to follow advice may affect the effectiveness of the treatment.

6. Medical data and privacy

Your data is processed in accordance with the General Data Protection Regulation (AVG), WGBO and the Care Quality, Complaints and Disputes Act (Wkkgz).
- Your data is only shared with directly involved healthcare providers within Menovia.
- You consent to request medical information from previous healthcare providers if necessary.
- Data can be used anonymously for quality improvement or scientific research, unless you object to this.

We use secure, certified software for data storage and communication. Your file will be kept for the legal period of 15 years.

7. Costs and reimbursement

You are aware that treatments at Menovia take place on a private basis.
- If you want to claim reimbursement through additional insurance, you must check this yourself.
- Cancellation of consultations must be made at least 24 hours in advance; otherwise, costs may be charged.

8. Complaints and disputes
We strive to guide you in a safe, respectful and professional manner. Nevertheless, do you have a complaint?

Then you can:
1. First report your complaint to Menovia via contact@menovia.nl. We take every report seriously and will respond within 4 weeks.
2. If you cannot work it out with Menovia, you can contact a recognized independent dispute committee: The Healthcare Disputes Committee (www.degeschillencommissie.nl).
3. You can also contact the Personal Data Authority if it concerns a complaint about the handling of your personal data: www.autoriteitpersoonsgegevens.nl.

Menovia acts in accordance with the requirements of the Wkkgz and is affiliated with a recognized complaints procedure. We think it's important that you feel heard and will do everything we can to find a suitable solution.

9. Consent You declare:
- That you have read and understood this information
- That you have had sufficient opportunity to ask questions
- That you voluntarily and deliberately consent to participate in the treatment and use of telehealth as described above
